Xiamen University "Patent and Copyright Protection" Special Training

Xiamen University invited a number of esteemed intellectual property firms to join the “2021 World Intellectual Property Day” theme training lecture for its teachers and students.

Senior patent attorney of Intenova IP Mr. Tang as the guest speaker first introduced and analyzed the main laws and regulations on the basis of patent and rights protection in China, including the Patent Law, the Implementing Rules, and the Judicial Interpretation of the Supreme Court, and the official policies and regulations, etc. Mr. Tang went further to explain in detail how the scope of patent infringement is defined in the above-mentioned laws and regulations, and how economic compensation is made if infringement is involved.

Secondly, regarding patent protection in China, Mr. Tang based on his own professional experience introduced three main processing methods, namely self-relief, administrative means and judicial methods, and explained the advantages and disadvantages of each in a comparative manner.

Mr. Tang also introduced the four main elements for successful patent protection (patents with stable rights, sufficient evidence of infringement, appropriate protection methods, a combination of all of the above, etc.). At the same time, Mr. Tang selected two specific cases to visually reproduce the then situation. The first was a successful case regarding selfie sticks, and the second was the failed AUX patent protection case. Through the comparative explanations the audience was able to have a clear overview of the industry.

Finally, Mr. Tang analyzed and publicized the main content of No. 411 "Measures on Regulating the Application of Patents" issued by the State Intellectual Property Office. In regards to the new trend of patent examination, Mr. Tang put forward some suggestions on how to make patent cultivation, application and management more standardized and efficient.
